Terms of Service — Trigwise

1. Acceptance of Terms

By accessing or using Trigwise ("the Service"), operated at trigwise.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Trigwise is an Instagram automation platform that enables business users to:

Set up keyword-triggered auto-replies to DMs and comments
Capture and manage leads from Instagram interactions
Send broadcast messages to engaged audiences
Use AI-powered responses for customer conversations
Track analytics on automation performance

The Service operates through the official Instagram Graph API provided by Meta Platforms, Inc.

3. Account Registration

You must create an account using Google OAuth to use the Service. You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Ensuring you have authorization to connect Instagram accounts you manage

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.

4. Acceptable Use

You agree NOT to use the Service to:

Violate Instagram's Terms of Use or Community Guidelines
Send spam, unsolicited messages, or harassing content
Impersonate other individuals or businesses
Distribute malware, phishing links, or deceptive content
Circumvent Instagram's rate limits or messaging policies
Collect or store Instagram user data for purposes outside the Service
Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Instagram 24-Hour Messaging Window

Instagram's platform policy restricts businesses from messaging users who have not interacted with their account within the last 24 hours. Trigwise enforces this restriction automatically. You acknowledge that:

Broadcast messages can only reach leads who messaged you within 24 hours
Audience counts displayed in the Service reflect this real-time constraint
We are not responsible for message delivery failures due to expired windows

6. Subscription Plans & Billing

Trigwise offers Free and paid (PRO) subscription tiers. By subscribing to a paid plan:

You authorize recurring billing through Razorpay at the stated rate
Plan limits (DMs per month, broadcasts per day) are enforced automatically
You may cancel at any time; access continues until the end of the billing period
Refunds are handled on a case-by-case basis; contact support for requests

We reserve the right to change pricing with 30 days' notice to existing subscribers.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

8. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by Trigwise. You retain ownership of all content you create or send through the Service (automation messages, broadcast templates, etc.). You grant us a limited license to process this content solely to provide the Service.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service depends on third-party infrastructure (Instagram API, Vercel, Neon) that may experience outages beyond our control. We are not liable for:

Instagram API downtime or rate-limit changes
Message delivery failures caused by Instagram policy changes
Temporary service interruptions for maintenance or upgrades

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIGWISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LEADS, OR DATA, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via the email associated with your account. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Bangalore, India.
